Laws restricting or banning per- and polyfluoroalkyl substances, also known as PFAS, will take effect in more than a half dozen states in 2023. Consumer products that are currently the subject of state PFAS laws include apparel and textiles, food packaging, carpets and rugs, fabric treatments, children’s products, cookware, cosmetics, furniture, and ski wax, but this is a continually evolving list.

Clark County Nevada, which includes Las Vegas, and the surrounding areas, has failed to achieve compliance with the health-based pollution standards set by the U.S. Environmental Protection Agency (EPA). These standards, called National Ambient Air Quality Standards (NAAQS), set acceptable ozone concentrations allowed in the air. Because Clark County has not met the ozone NAAQS, it is required to develop and impose new regulations designed to reduce the precursors of ozone, which are Volatile Organic Compounds (VOC) and Nitrogen Oxides (NOx).

The State of Colorado is requiring employers to facilitate a retirement savings plan for their employees with the Colorado SecureSavings program. Employers are not required to contribute to either their existing qualified retirement plan or the new SecureSavings plan. Rather, the state is trying to encourage workers to save for retirement and creating a vehicle for retirement contributions in situations where no qualified retirement plan already exists.

The first New Jersey law, signed on February 6, 2023, will provide workplace employment protections for temporary workers. The first provisions of the new law go into effect on May 7 and the remaining provisions go into effect August 5. The second law modifies New Jersey WARN regulations, which require employers who are planning large layoffs to provide prior notice to the state and the employees. Among other provisions, part-time employees are now included in the head count.
