    The U.S. Environmental Protection Agency (EPA) has proposed to amend Part 302 of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), also known as the Superfund law, to add per- and polyfluoroalkyl substances (PFOA/PFOS, collectively, PFAS) to the list of “hazardous substances.” f finalized, the designation of PFOA and PFOS as CERCLA “hazardous substances” will create new reporting obligations and significantly increase the risk of enforcement and litigation related to the cleanup of contaminated sites.

    Effective January 6, 2023, the Federal Motor Carrier Safety Administration (FMCSA), an agency under the Department of Transportation (DOT) that regulates the trucking industry in the United States, updated its regulations on drug and alcohol testing reporting and inquiry. The new rule requires employers to include in their background investigation if a prospective Commercial Driver’s License (CDL) driver had previous drug and alcohol program violations within the past three years before hiring the driver.

    The Maine DEP established a reporting requirement that applied to food packaging and packaging components of products that contain Per- and Polyfluoroalkyl Substances (PFAS). However, the DEP has changed its position and is now stating that packaging for a product “is not required to be reported” under the state’s new PFAS notification and reporting requirement. The change in position by the DEP is welcomed and should provide some relief for many companies.
