Federal Government Issues Guidance About Artificial Intelligence Use in HR Decisions

The U.S. Equal Employment Opportunity Commission (EEOC) issued Guidance on May 18, 2023, to remind employers that Artificial Intelligence (AI) systems which are used in human resources decisions need to be closely monitored to avoid violating Title VII of the Civil Rights Act of 1964. Title VII prohibits discrimination based on race, color, religion, sex, or national origin. In addition, federal statutes prohibit discrimination against people aged 40 or older and people with disabilities. The use of AI is being analyzed and explored as part of the EEOC’s “Artificial Intelligence and Algorithmic Fairness Initiative” to ensure that these protected classes of people are not negatively affected. -
