The U.S. Environmental Protection Agency (EPA) has proposed to amend Part 302 of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), also known as the Superfund law, to add per- and polyfluoroalkyl substances (PFOA/PFOS, collectively, PFAS) to the list of “hazardous substances.” f finalized, the designation of PFOA and PFOS as CERCLA “hazardous substances” will create new reporting obligations and significantly increase the risk of enforcement and litigation related to the cleanup of contaminated sites. -

Effective January 6, 2023, the Federal Motor Carrier Safety Administration (FMCSA), an agency under the Department of Transportation (DOT) that regulates the trucking industry in the United States, updated its regulations on drug and alcohol testing reporting and inquiry. The new rule requires employers to include in their background investigation if a prospective Commercial Driver’s License (CDL) driver had previous drug and alcohol program violations within the past three years before hiring the driver. -
