In essence, the instance-by-instance changes are designed to have each alleged violation itemized in a citation so that the maximum penalty for each one can be applied.

    On October 27, 2023, the California Office of Environmental Health Hazard Assessment (OEHHA) issued a Notice of Proposed Rule Making to amend the Safe Drinking Water and Toxic Enforcement Act of 1986, better known as Prop-65. Prop-65 requires businesses to provide a “clear and reasonable” warning on products that contain chemicals exceeding an established safe harbor level and have been deemed to cause cancer or reproductive toxicity by the state.
