The Department of Labor (DOL) proposed revisions to the Fair Labor Standards Act (FLSA) on August 30, 2023. The most significant proposed revision to the FLSA expands who may receive overtime compensation, and the threshold salary up to which overtime pay is required. The proposed revisions also clarify how an employee’s regular rate of pay is calculated, identifying which perks and benefits cannot be figured into that pay rate.

The Occupational Safety and Health Administration (OSHA) proposed a new rule on August 29, 2023, that would allow any third-party, non-employee, union representative to accompany an OSHA inspector as they conduct an inspection. This includes companies that are not a union shop. Currently, the rule is that a union representative may only accompany an OSHA inspector if that person is an employee of the company that is being inspected.

The Occupational Safety and Health Administration (OSHA) has convened a panel of small businesses to review the Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings proposed rule. This is the next step in a process that began in October 2021 when action on the rule was initiated with an advanced notice of proposed rulemaking. SuperGraphics, a PRINTING United Alliance member located in Seattle, WA, agreed to serve on the OSHA Small Business Advocacy Review (SBAR) Panel, in consultation with the Alliance, to represent printing industry interests.

WASHINGTON – The U.S. Government Publishing Office (GPO) has completed an effort to digitize and make available all historic Congressional Directories on GovInfo, the one-stop site to authentic information published by the Federal Government. The public now has free and easy access to nearly 130 years of additional directories and can explore directories from the 41st Congress (1869–1870) through the 117th Congress (2021-2022). Future Congressional Directories will continue to be released on GovInfo as they are completed.

Unfortunately, no workplace is immune from experiencing incidences of workplace violence. OSHA has now clarified how injuries that result from a workplace violence incident are to be classified under their injury and illness recordkeeping regulation found at 29 CFR 1904. On May 17, 2023, OSHA issued an interpretation letter that addresses when employers are required to record in their OSHA 300 logs on-the-job injuries and deaths caused by violent acts. The letter was issued in response to a clarification request for a situation where an employee was driving a company vehicle, on the clock, and traveling on a public roadway.

Small businesses are facing a dramatic tax increase starting January 1, 2026, when a 20 percent tax deduction for income expires. The deduction was included in the Tax Cuts and Jobs Act (TCJA) of 2017. TCJA allowed small businesses structured as pass-through entities, like sole proprietorships, S corporations, partnerships, or limited liability companies, to deduct up to 20 percent of their business income. However, unless Congress makes the deduction permanent, the significant small business tax savings will expire in approximately two years, on December 31, 2025.
