Trade Policy Update: Legal Challenges Underway, New Tariffs on Steel and Aluminum

On May 28, 2025, the U.S. Court of International Trade ruled that President Donald Trump overstepped his authority by imposing some of the new broad tariffs under the International Emergency Economic Powers Act (IEEPA) and ordered that they be rescinded. The following day the U.S. Court of Appeals temporarily stayed the lower court's decision and reinstated those tariffs. The appellate court granted a longer stay on June 10, 2025 and will hear oral arguments on July 31, 2025.
