  • ADVOCACY ALERT: Protect Consumer Choice for Paper Communications

    The U.S. Securities and Exchange Commission (SEC) and the U.S. Department of Labor (DOL) have each issued proposed rules that would shift the delivery of important disclosures from a consumer "opt-in" model to an "opt-out" model for paper communications. While consumers would still be able to request paper copies, these proposals would automatically enroll millions of Americans in electronic delivery unless they take action to choose otherwise.

  • Oregon EPR Survives Constitutional Challenge

    On August 27, the U.S. District Court for the District of Oregon upheld the state’s Plastic Pollution and Recycling Modernization Act (RMA), rejecting claims that the law’s extended producer responsibility (EPR) program is unconstitutional. The ruling followed a five-day trial in July over a legal challenge brought by the National Association of Wholesaler-Distributors (NAW).

  • Postal Regulatory Commission Denies USPS January Rate Hike Request

    On August 21, the Postal Regulatory Commission (PRC) denied the U.S. Postal Service's (USPS) request for a waiver, concluding that USPS had not demonstrated good cause for deviating from existing rules, had not shown that the proposed change would be consistent with the public interest, and had failed to establish that the request would not unfairly prejudice other participants in the proceeding. The Commission's order cited industry concerns on multiple occasions, underscoring the importance of transparency and adherence to the regulatory framework governing postal rate adjustments.

  • Federal Court Blocks Enforcement of California SB 343 “Truth in Recycling” Law

    On July 14, 2026, the U.S. District Court for the Southern District of California issued a preliminary injunction barring the California Attorney General from enforcing Senate Bill 343 (SB 343), California’s “Truth in Recycling” law, until further order of the court. SB 343 had been scheduled to become operative on October 4, 2026, and would have significantly limited when businesses could use the chasing-arrows recycling symbol or other recyclability claims on products and packaging sold in California.
