It’s Time to Update Policies for Pregnant, Postpartum, and Nursing Employees: A Summary of New Laws

The Pregnant Workers Fairness Act (PWFA)

At the end of 2022, Congress passed two new laws that provide workplace accommodation and protections to pregnant employees and nursing mothers. Existing laws such as the Pregnancy Discrimination Act (PDA), the Americans with Disabilities Act (ADA), and the Family and Medical Leave Act (FMLA) provide protections and reaffirm rights for pregnant and post-pregnant employees. The new laws address gaps in protections and specifically address conditions related to pregnancy and lactation.
