The Sixth Circuit Court of Appeals has lifted the stay on the Emergency Temporary Standard (ETS) that the federal Occupational Health and Safety Administration issued in November. The Sixth Circuit issued its ruling on December 17, 2021. The ETS impacts all employers of 100 employees or more. Additionally, it is recommended that you check with your state agency as to any requirements that have been put in place as a few states, most notably California and Virginia, have adopted their own state specific rules.
