Restrictions on Direct Mail

Should federal or state* “Do Not Mail” legislation, which would restrict advertising mail, be passed ?

Background
Legislation has been introduced to create “Do Not Mail” registries for business-to-consumer and business-to-business mail. In 2009, legislation has been introduced in Connecticut, Florida, New Jersey, and New York but has not received serious consideration in any of those states. In 2008, legislation was introduced in 12 states. To date, no bill has seen a floor vote. Printing Industries of America and its affiliates* have successfully stemmed the opposition’s traction on the state-based campaigns. At the municipal level, the San Francisco Board of Supervisors recently passed a non-binding resolution calling for Do Not Mail legislation to be introduced on the state and federal level. The so-called Do Not Mail initiatives are driven largely by environmental organizations purporting advertising mail’s negative impact on the environment.

111th Congress and Obama Administration
Do Not Mail legislation has not been introduced on the federal level but it remains a primary goal of activist groups. Since introducing legislation is a relatively easy process, a federal Do Not Mail bill could be introduced with little or no advance notice. President Obama has not taken a public stand on the issue.
